POLICES AND PROCEDURES

These policies and procedures form the basic agreement between the buyer and MUSKOGEE AUTO AUCTION LLC. All buyers and their representatives who do business through MUSKOGEE AUTO AUCTION LLC are deemed to have read, know, understand, and are subject to, and bound by these policies and procedures, as they may be amended from time to time. Lack of knowledge concerning these policies and procedures will not release buyers or their representatives from their obligations to abide by them. MUSKOGEE AUTO AUCTION LLC reserves the right to interpret these policies and procedures, and to decide all issues of dispute concerning same; MUSKOGEE AUTO AUCTION LLC decisions shall be final and binding.

It shall be the responsibility of all buyers and their representatives to review and be aware of these policies and procedures, and any other rules of MUSKOGEE AUTO AUCTION, including any revisions thereto, before doing business with MUSKOGEE AUTO AUCTION. Buyers and their representatives who do not comply with these policies and procedures may be barred from doing business with MUSKOGEE AUTO AUCTION LLC. These policies and procedures shall be the general policies of MUSKOGEE AUTO AUCTION LLC for all transactions.

MUSKOGEE AUTO AUCTION LLC IS AN INDEPENDENT FAMILY-OWNED AUTO AUCTION THAT IS OPEN TO THE GENERAL PUBLIC. MUSKOGEE AUTO AUCTION LLC RESERVES THE RIGHT TO REFUSE TO DO BUSINESS WITH ANYONE, AND TO REFUSE ACCESS TO ANYONE AT ANY TIME.

1. All dealers and public must check in and receive a bidder’s badge before bidding.

2. Tampering, vandalism or destructive behavior will not be tolerated.

3. Bid-sheet comments and/or announcements are provided as courtesy only. The information is not to be relied upon as complete and /or accurate and is not subject to arbitration.

4. Buyer must verify year, make, model, miles and condition of vehicle.

5. All vehicles sold through MUSKOGEE AUTO AUCTION LLC are sold “AS-IS”, unless announced as guaranteed or frontline. All taxicabs, police cars, electric cars, boats, motorcycles, ATV, travel trailers, trailers and motorhomes will be sold “AS-IS” (RED LIGHT).

6. All sales are subject to final approval by management.

7. Honor bids. Failure to honor bid(s) or pick up car(s) will result in the auction reselling the vehicle. Should a balance remain, the dealer will be responsible for any deficit.

8. Pay for and remove vehicles from the sale location by 5:00PM on Thursday following the sale date NO LATER.

9. MUSKOGEE AUTO AUCTION LLC assumes no responsibility for lost/stolen radios, equipment or minor damage.

10. All vehicles sold under $3500.00 will be sold “AS-IS”(RED LIGHT).

11. MUSKOGEE AUTO AUCTION LLC is not responsible for any vehicles left at the auction lot overnight.

12. MUSKOGEE AUTO AUCTION LLC does not provide any insurance coverage on any vehicles. Customer assumes all risks and liabilities.

13. MUSKOGEE AUTO AUCTION LLC assumes absolutely no responsibility for year, make, model or the odometer mileage. Not for the validity of the mileage statement provided by the seller to the buyer. Seller must announce if the odometer is not working properly.

14. Any vehicle left longer than 5 days without prior management approval will be subject to storage fees.

TITLE

MUSKOGEE AUTO AUCTION LLC will provide buyer with a clear title within 30 days of date of sale. When a clear title is available, MUSKOGEE AUTO AUCTION LLC will notify buyer. Titles may be picked up or mailed at the buyer’s request. Any and all unannounced title issues must be reported to MUSKOGEE AUTO AUCTION LLC within 5 business days of receipt of title. Day one begins the day after deposit notification. In the case of a title being more than 30 days, the buyer must notify MUSKOGEE AUTO AUCTION LLC that he/she intends to cancel the sale. Buyer must allow 5 business days from date of notice for MUSKOGEE AUTO AUCTION LLC to produce a clear title before vehicle may be returned. If the sale is cancelled at the buyer’s request, no expense reimbursement will be allowed.

NOTICE TO ALL BUYERS: DO NOT INCUR EXPENSES ON A UNIT PURCHASED WITH A TITLE "NOT PRESENT". THE AUCTION AND/OR SELLER WILL NOT REIMBURSE FOR ANY EXPENSES.

Data received from vehicle history information services (such as, Carfax or Autocheck, etc.) is not, in and of itself, proof of a defect in a vehicle or its title history. Nor will a Carfax or Autocheck, etc. problem be subject to arbitration.

FRAME, FLOOD, FIRE, ENGINE CHANGES, FUEL CONVERSION & AIR BAG

With the exception of a branded title, no announcement of body, flood, or fire damage will be made. Announcements for deployed air bag or air bag light will be made if it’s known by the auction staff. No announcements will be made for engine changes or fuel conversion.

MUSKOGEE AUTO AUCTION LLC gives the buyer every opportunity to look over and make his/her own determination on all vehicles for sale. It is the buyer’s responsibility to do this. Please do not rely on auction staff to make these decisions for you. All information and opinions offered by the auction staff are for courtesy only.

As a buyer, you may use these comments to any degree you choose, but they are not grounds for arbitration or failure to complete a transaction. ALL SALES ARE FINAL.

RETURNED CHECK OR RETURNED DRAFT FEE $100

PUBLIC BUYERS MUST PUT UP A $500 DEPOSIT ON EVERY VEHICLE THAT THEY PLAN ON BUYING.

NO CHILDER UNDER THE AGE OF 16 IS ALLOWED ON THE PREMISES
